-All requests to use the Athletic Sports facilities will be made to the Sports & Fitness department by the individual of said team or league sports organization.
-Organizations or individual using sports facilities must be in agreement with respective times and dates prior to the start of the event.
-A new request must be submitted if organization wishes to change dates or times.
-Organization must have proper insurance.
-No concessions will be available, without the consent of the Sports Coordinator.
-All trash must be picked up which includes fields, dugouts, in and around area to be used by an organization.
-Organization will be assessed the cost of repairs and/or replacement of damaged property and/or equipment as determined by administration personnel.
-Village of Los Lunas will not be responsible for any injury or accident occurring during the use of the facility.
-The sponsoring agent shall hold harmless and indemnify the Village, its governing body, officers, employees, agents, from all claims, liabilities, obligations, loses, and the like, asserted by any third parties arising from or caused by the sponsoring agent negligence, misrepresentation, fraud, or any other acts. The indemnity and hold harmless agreement shall include reimbursement of all attorney fees, costs and expenses incurred by the village, its governing body, officers, employees or agent. As between the parties each party shall be solely responsible for any and all liability arising from personal injury, including death or damage to property arising from the act or failure to act of the respective party or of its officials. Agents and employees pursuant to this agreement . The liability to the Village shall be subject to the immunities and limitations or the tort claims ACT, 41-41-1 N.M.S.A 1978 ET SEQ and any amendments thereto.
